1. Parties and Acceptance

These Terms & Conditions ("Terms") govern your use of the WeSpend application and website at wespend.app ("Service"), operated by Dmitriy Maletskiy ("we", "us", "our"). By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, if higher) to use the Service. By using the Service, you represent and warrant that you meet this requirement.

3. Description of Service

WeSpend is a personal and family finance tracking application that allows users to record transactions, manage accounts in multiple currencies, monitor budgets, view analytics, and optionally connect bank accounts via Open Banking. The Service is provided for personal, non-commercial use only.

4. Account Registration

  • You may register using a Google account or Telegram account.
  • You are responsible for maintaining the confidentiality of your session and for all activity that occurs under your account.
  • You agree to provide accurate, current, and complete information.
  • You must notify us immediately at i@nomad.gd if you suspect unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws or regulations;
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure;
  • Probe, scan, or test the vulnerability of any system or network;
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service;
  • Transmit any malicious code, viruses, or harmful data;
  • Use automated tools (bots, scrapers, crawlers) to access the Service;
  • Interfere with or disrupt the integrity or performance of the Service or data contained therein;
  • Impersonate any person or entity.

6. No Financial Advice

WeSpend is a personal finance tracking tool only. Nothing in the Service constitutes financial, investment, tax, accounting, or legal advice. We do not recommend any financial products, securities, or strategies. Past transaction data and analytics displayed in the Service are for informational purposes only. You should consult a qualified financial or legal professional for advice specific to your situation.

7. Open Banking

Connecting a bank account is entirely optional. By connecting a bank account you:

  • Authorise WeSpend to retrieve your account and transaction data via Enable Banking's Open Banking API on your behalf;
  • Acknowledge that this connection is subject to your bank's terms and the terms of Enable Banking;
  • Understand that synced data may be incomplete or delayed due to bank processing times;
  • Retain the right to revoke this authorisation at any time from the app settings.

8. Your Data

You retain full ownership of the financial data you enter into the Service. We do not claim any intellectual property rights over your data. By using the Service, you grant us a limited licence to store and process your data solely to provide the Service. This licence terminates when you delete your account.

9. Data Accuracy

You are solely responsible for the accuracy of the data you enter. WeSpend is not responsible for errors, omissions, or inaccuracies in your financial records. When bank transactions are imported automatically, the data reflects what your bank reports and may differ from your own records due to pending transactions, bank processing delays, or currency conversions.

10. Intellectual Property

The Service, including its design, source code, trademarks, and all content created by us, is owned by Dmitriy Maletskiy and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works without prior written permission.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any data or analytics displayed in the Service.

12. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Service, including but not limited to:

  • Loss of data or financial information;
  • Errors in balance calculations, transaction categorisation, or analytics;
  • Unauthorised access to your account or data;
  • Interruption, suspension, or discontinuation of the Service;
  • Financial loss resulting from reliance on data displayed in the Service.

Our total aggregate liability to you for all claims arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid for the Service in the twelve months preceding the claim, or (b) €10.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential damages, so the above limitations may not apply to you.

13. Service Availability and Changes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. For material changes, we will provide reasonable advance notice where possible. We are not liable for any losses resulting from modifications or interruptions to the Service.

14. Termination

By you: You may delete your account at any time from the app settings. Upon deletion, your data will be permanently removed within 30 days.

By us: We may suspend or terminate your account with immediate effect if you breach these Terms, engage in fraudulent activity, or if required by law. Where possible, we will provide notice and an opportunity to remedy the breach.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the European Union and applicable national law. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved amicably by contacting i@nomad.gd. If not resolved within 30 days, disputes shall be submitted to the competent courts of the jurisdiction in which the data controller operates.

If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, via an in-app notice. The current version is always available at wespend.app/legal/terms. Continued use of the Service after the effective date of changes constitutes your acceptance of the revised Terms.
